Terms and Conditions
Terms and Conditions
These Terms and Conditions ("Agreement") govern the services provided by [Dorset Removal Services] ("we," "our," or "us") in connection with house moving and office removal services. By using our services, you ("the customer," "you," or "your") agree to the following terms:
1. Scope of Services
We provide residential and commercial moving services, including but not limited to packing, transportation, unloading, and storage of goods. The specific services provided will be outlined in the individual agreement for each move.
2. Booking and Payment

A booking is confirmed once a deposit or full payment (depending on the terms agreed) has been received.

Full payment is due upon completion of the move unless otherwise agreed in writing.

Payments can be made via credit card, bank transfer, cash.
-
If payment is not received on the scheduled date, we reserve the right to cancel the move or charge a late payment fee.
3. Liability
-
We limit or exclude our liability for loss, theft, or damage to goods during the move, except in cases of proven negligence.

We recommend that you arrange insurance to cover your goods during the move. If requested, we can assist you in arranging insurance, which will be separate from this contract and subject to the terms and conditions of the insurance policy.
4. Customer Responsibilities
-
It is your responsibility to ensure that all goods are packed securely prior to the move unless you request our packing services.

You must ensure that any fragile or valuable items are properly packed, and you must notify us of any such items ahead of the scheduled move.
-
We are not responsible for damage to items that are not packed by us or for damage to walls, floors, or doors caused by moving large or bulky items.
-
You must provide access to the property on the agreed moving day and time. If access is not available or there are unforeseen delays, additional charges may apply.

We shall not be liable for loss or damage caused by fire or explosion, unless we have been negligent or in breach of contract. It is Your responsibility to insure Your Goods. If You ask Us in writing to arrange insurance cover for You, We will, provided You declare the full replacement value of Your Goods and pay the premium in advance.

Unless previously agreed in writing by a director or other authorised company representative, the following items must not be submitted for removal or storage and will under no circumstances be moved or stored by Us. The items listed below are: Potentially dangerous, damaging or explosive items, including gas bottles, aerosols, paints, firearms, fuels, oils, and ammunition. Jewellery, watches, trinkets, precious stones or metals, money, deeds, securities, mobile telephones, portable media and computing devices, stamps, coins, or goods or collections of any similar kind. Goods likely to encourage vermin or other pests or to cause infestation or contamination. Perishable items and/or those requiring a controlled environment. Any animals, birds, fish, reptiles or plants. Goods which require special licence or government permission for export or import.

Under no circumstances will Prohibited or stolen goods, drugs or pornographic material be moved or stored by Us. If You submit such goods without Our knowledge We will make them available for Your collection and if You do not collect them within a reasonable time We may apply for a court order to dispose of any such goods found in the consignment. You agree to pay Us any charges, expenses, damages, legal costs or penalties reasonably incurred by Us in disposing of the goods.
5. Changes and Cancellations
-
If you postpone or cancel this Agreement, we reserve the right to charge a reasonable postponement or cancellation fee based on the amount of notice provided, as detailed below. "Working days" refer to Monday to Friday and exclude weekends and Public Holidays. These fees reflect the losses we may incur as a result of your cancellation or postponement. Examples of such losses include, but are not limited to: Administrative or back-office costs,The inability to fill the vacated removal slot with another customer, or Costs associated with engaging employees for your scheduled removal.

More than 10 working days before the removal was due to start: No charge.
-
Between 5 and 10 working days inclusive before the removal was due to start: not more than 30% of the removal charge
-
Less than 5 working days before the removal was due to start: not more than 60% of the removal charge
-
Within 24 hours before the removal was due to start: not more than 75% of the removal charge.
-
On the day the work starts or at any time after the work commences: 100% of the removal charge.
-
We reserve the right to cancel or reschedule the move if circumstances beyond our control (e.g., weather, vehicle breakdown, etc.) make the move impossible.
6. Insurance
-
We strongly recommend that you arrange for insurance coverage for your goods during the move. This can be done through a third-party provider or via an insurance policy we can arrange for you upon request.

Insurance arranged by us is separate from this contract and subject to the terms and conditions of the policy. We are not liable for any issues related to insurance policies, including claims or exclusions.
7. Force Majeure
We shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, accidents, or governmental restrictions.
9. Route and method

We have the right to choose the method and route by which to carry out the work and the location in respect of storage.

Unless it has been specifically agreed otherwise in writing in our Quotation, other space/volume/capacity on Our vehicles and/or the container may be utilized for consignments of other customers.
10. Exclusion of liability
-
We will not be liable for any loss of, damage to, or failure to produce the following goods: Bonds, Securities, Stamps of all kinds, Manuscripts or other Documents or Electronically held Data Records, Mobile Telephones. Plants or goods likely to encourage vermin or other pests or to cause infestation or contamination. Perishable items and/or those requiring a controlled environment. Furs exceeding £100 in value, Jewellery, Watches, Precious Stone sand Metals, Money, Coins, Deeds. Any animals, birds or fish.

We shall not be liable for delays or failures to provide the services under this Agreement as a result of: war, invasion, acts of foreign enemies, hostilities (whether war is declared or not), civil war, terrorism, rebellion and/or military coup, Act of God, adverse weather, third party industrial action, re-scheduled sailing, departure or arrival times, port congestion, or other such events outside our reasonable control.

We will not be liable for loss or damage arising from Chemical, Biological, Bio-chemical, Radioactive, Electromagnetic activity and or weapons and Cyber Attack.

Other than as a result of Our negligence or breach of contract We will not be liable for any loss, damage or failure to produce the goods as a result of: Normal wear and tear, natural or gradual deterioration, leakage or evaporation or from perishable or unstable goods. This includes goods left within furniture or appliances. Moth or vermin or similar infestation. Cleaning, repairing or restoring unless We arranged for the work to be carried out.Changes caused by atmospheric conditions such as dampness, mould, mildew, rusting, tarnishing, corrosion, or gradual deterioration unless directly linked to ingress of water.

OR For any goods in wardrobes, drawers or appliances, or in a package, bundle, carton, case or other container not both packed and unpacked by Us. Loss of or damage to china, glassware and fragile items unless they have been both professionally packed and unpacked by us or our Subcontractor. In the event of an accident involving an owner packed container where damage would have occurred irrespective of the quality of the packing, then our liability is limited to £100 or its actual value whichever is less. For electrical or mechanical derangement to any appliance, instrument, clock, computer or other equipment unless there is evidence of related external damage. Loss or damage of motor vehicles caused by scratching, denting and marring unless you obtain from us a pre-collection condition report. For any goods which have a pre-existing defect or are inherently defective. For perishable items and/or those requiring a controlled environment. Loss of structural integrity of furniture constructed of particle board resulting from crumbling of the board.

For items referred to in Clause 4. No employee of Ours shall be separately liable to you for any loss, damage, mis- delivery, errors or omissions under the terms of this Agreement. Where goods are handed out from store Our liability will cease upon handing over the goods to You or Your authorised representative.

We will not be liable for any loss or damage caused by Us or Our employees or agents in circumstances where:
-
(a) there is no breach of this Agreement by Us or by any of Our employees or agents
-
(b) such loss or damage is not a reasonably foreseeable result of any such breach.
Time limit for claims
-
If You or Your authorized representative collect the goods, We must be notified in writing of any loss or damage at the time the goods are handed to You or Your agent or as soon as practically possible.
-
We will not be liable for any loss of or damage to the goods unless a claim is notified to us, or to our agent or the company carrying out the collection or delivery of the goods on our behalf. This must be in writing as soon as such loss or damage is discovered (or with reasonable diligence ought to have been discovered) and in any event in detail within seven (7) days of delivery of the goods, in order to properly investigate the claim. We may agree to extend this time limit upon receipt of Your written request provided such request is received within seven (7) days of delivery. Consent to such a request will not be unreasonably withheld.
11. Confidentiality
We are committed to protecting your privacy and confidentiality. Any personal information provided will be used solely for the purpose of completing the services outlined in this Agreement and will not be shared with third parties without your consent.
12. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from your failure to comply with these Terms and Conditions, including but not limited to improper packing, failure to disclose fragile or valuable items, or violations of the laws.
13. Governing Law
Any dispute between us will be governed by the non-exclusive jurisdiction and laws of the English or Scottish Courts. If you currently reside in, or are relocating to, a location outside the jurisdiction of the United Kingdom Courts, alternative laws or the jurisdiction of local courts may apply, provided this is agreed upon in writing by both parties before the commencement of the work or services.
14. Amendments
We reserve the right to amend or update these Terms and Conditions at any time. Any changes will be posted on our website, and your continued use of our services will be considered as acceptance of the updated Terms and Conditions.
